These Terms and Conditions («Terms») constitute a binding agreement between Amazon Huasai Tours («the Agency», «we», «our») and the client («you», «your», «traveler»). By confirming a reservation, you acknowledge that you have read, understood, and accepted the following terms.
1. Reservations and Contractual Relationship
1.1 A reservation is considered confirmed once the required deposit or full payment is received and written confirmation has been issued by the Agency.
1.2 The person making the reservation declares they have the authority to accept these terms on behalf of all participants included in the booking.
1.3 The contract between the client and Amazon Huasai Tours comes into effect once written confirmation is issued.
2. Payments and Deposits
2.1 A non-refundable deposit (as specified in the itinerary) is required to confirm your reservation.
2.2 Full payment must be made no later than 30 days before the tour starts, unless otherwise stated.
2.3 If full payment is not received by the deadline, the Agency reserves the right to cancel the reservation without refunding the deposit.
3. Cancellations and Refunds
Client Cancellations:
3.1 All cancellations must be submitted in writing via email or certified message.
3.2 Refunds will be issued according to the following schedule:

More than 45 days before departure: 80% refund of the total payment

Between 30 and 44 days: 50% refund

Between 15 and 29 days: 25% refund

Less than 15 days: No refund
3.3 No refunds will be issued for unused services, late arrivals, or early departures.
Agency Cancellations:
3.4 The Agency reserves the right to cancel a tour due to force majeure, insufficient enrollment, or unforeseen operational circumstances. In such cases, a full refund or travel credit will be offered, excluding any third-party expenses already incurred.
4. Modifications
4.1 You may request changes to your itinerary. The Agency will make reasonable efforts to accommodate such changes, but does not guarantee availability or price stability.
4.2 The Agency reserves the right to modify the itinerary, accommodations, transportation, or activities for safety, weather, or logistical reasons without prior notice or entitlement to a refund.
5. Travel Insurance
5.1 It is strongly recommended that all travelers purchase comprehensive travel insurance covering cancellations, medical emergencies, civil liability, baggage loss, and evacuation.
5.2 It is the client’s responsibility to ensure the insurance purchased is appropriate for travel in the Peruvian Amazon.
6. Health, Safety, and Responsibility
6.1 You declare that you are physically and mentally fit to participate in all activities included in the tour.
6.2 You must inform the Agency in advance of any medical conditions, allergies, or dietary restrictions that may affect your participation.
6.3 The Agency reserves the right to immediately exclude, without refund, any participant who poses a risk to themselves or others, or who disrupts the group experience.
7. Passports, Visas, and Entry Requirements
7.1 It is the client’s responsibility to have a passport valid for at least six (6) months after the return date and to meet visa and entry requirements for Peru.
7.2 Amazon Huasai Tours is not responsible for expenses or losses due to denial of entry or boarding resulting from invalid documentation or failure to comply with immigration regulations.
8. Limitation of Liability
8.1 Amazon Huasai Tours acts as an intermediary between the client and independent service providers (accommodation, transport, guides, etc.). We assume no responsibility for acts, errors, omissions, or negligence of third parties.
8.2 Tours in the Amazon involve inherent risks and unpredictable conditions, such as:

Extended navigation on Amazon rivers and tributaries

Hikes in remote or undeveloped primary rainforest

Exposure to insects, wildlife, and natural elements

Sudden changes in weather, water levels, and terrain
While Amazon Huasai Tours takes all reasonable precautions to ensure safety, clients acknowledge these risks as a natural part of the journey and accept them voluntarily.
8.3 The Agency is not responsible for injury, illness, delays, losses, or inconveniences caused by force majeure events such as natural disasters, civil unrest, pandemics, or government actions.
8.4 The client releases Amazon Huasai Tours, its employees, representatives, and affiliates from liability for personal injury, property loss, or other claims, unless gross negligence or intentional misconduct by the Agency is proven.
8.5 It is recommended to have insurance that includes medical evacuation and emergency assistance.
9. Claims and Dispute Resolution
9.1 Any complaint must be immediately communicated to the tour guide or coordinator to attempt resolution on the spot.
9.2 If unresolved during the trip, the claim must be submitted in writing to the Agency within 14 days of the tour’s conclusion.
9.3 These Terms are governed by the laws of the Republic of Peru. Any disputes will be resolved by the competent courts in the Loreto region, Peru.
10. Image and Likeness Use
10.1 You authorize the use of photographs or videos taken during the trip for promotional purposes by Amazon Huasai Tours, unless you notify the Agency in writing before the tour begins.
11. Privacy Policy
11.1 Amazon Huasai Tours respects your privacy and is committed to protecting your personal data.
11.2 Information collected will be used solely to manage your reservation, communication, and trip operation. It will not be shared with third parties unless required by law or for the fulfillment of contracted services.
12. Acceptance of Terms
12.1 By confirming a reservation with Amazon Huasai Tours, you accept these Terms and Conditions on your own behalf and on behalf of all participants included in the booking.
